You’re getting ready to haul a small load. Maybe it’s a lawn tractor, a few pallets of lumber, or a utility trailer with an ATV on it. You know the trailer doesn’t have electric brakes, and now you’re wondering whether towing it is legal. Good question. The honest answer depends on the trailer’s actual loaded weight, its manufacturer-assigned Gross Vehicle Weight Rating (GVWR), the type of braking system it has, the state where it is being operated, and whether the combination is being used in commerce.
For ordinary personal towing, state vehicle-equipment laws usually provide the most immediate brake requirements. However, it is not accurate to say that trailer braking is never regulated federally. The Federal Motor Carrier Safety Regulations contain separate brake rules for covered commercial motor vehicles used in interstate commerce. State laws also vary considerably: some begin requiring brakes around 1,500 or 2,000 lbs, many use a 3,000-lb threshold, others use a higher threshold, and some rely partly on the trailer-to-tow-vehicle weight ratio or required stopping performance. When a trip crosses state lines, do not assume that one simple nationwide chart settles every legal question.
Why Trailer Brakes Exist in the First Place
A tow vehicle’s braking system is designed around the vehicle manufacturer’s GVWR, Gross Combination Weight Rating (GCWR), axle ratings, tire ratings, and towing instructions. Adding a trailer increases the total moving mass that must be slowed during every stop. Even when the truck and trailer are within all published ratings, the combination generally requires more distance to stop than the unloaded tow vehicle. At highway speed, a heavily loaded trailer without its own brakes can place a tremendous additional demand on the tow vehicle’s brake system.
Electric trailer brakes create braking force at the trailer wheels instead of asking the tow vehicle to handle the entire stop by itself. With a properly installed and adjusted proportional brake controller, trailer-brake output generally increases in relation to the tow vehicle’s deceleration. Time-delayed controllers work differently, applying a preset amount of braking according to their gain and timing settings. Either type must be compatible with the trailer, wired correctly, and adjusted for the current load.
A correctly functioning trailer-brake system helps keep the combination aligned, reduces heat and wear in the tow vehicle’s brakes, and improves control during hard stops, downhill travel, and changing road conditions. Trailer brakes do not increase the truck’s tow rating, payload rating, axle ratings, hitch rating, or GCWR. They are a required safety system on many trailers, not permission to exceed the tow vehicle’s limits.
Without adequate trailer braking, the trailer can continue pushing the tow vehicle as the driver attempts to stop. If traction is uneven, the trailer is loaded improperly, or the driver makes a sudden steering input, that pushing force can contribute to sway, loss of directional control, or a jackknife. Indiana’s hills, wet pavement, rural intersections, and deer traffic can turn a marginal braking setup into an emergency very quickly.
The General Weight Thresholds (and Why They Vary)
Here is a more accurate picture of how trailer-brake laws are commonly structured. These are broad patterns rather than a substitute for the current statute in the state where you will be operating. Pay close attention to whether a law refers to actual gross weight, registered weight, unladen weight, GVWR, the number of axles, or the trailer’s weight in relation to the tow vehicle.

Indiana Code 9-19-3-3 applies when a trailer or semitrailer has a gross weight of at least 3,000 lbs while being operated on a highway. The statute requires brakes that can control, stop, and hold the trailer, that can be applied by the driver from the towing vehicle’s cab, and that apply automatically if the trailer accidentally separates. Indiana Code 9-19-3-4 also generally requires service brakes on all wheels of a new trailer sold in Indiana and operated on the highway, with an exception for a trailer or semitrailer weighing less than 3,000 lbs. The legal language uses gross weight, meaning the weight of the trailer and its load, rather than relying exclusively on the advertised GVWR.
A current Diamond C LPX equipment trailer is far above that threshold. The LPX is a bumper-pull, low-profile equipment trailer offered in GVWR configurations from 15,500 to 24,000 lbs, with two 7,000-lb Lippert axles standard and heavier Lippert axle packages available. A 20-foot LPX therefore requires a fully functioning brake system in Indiana; its brakes and breakaway equipment are not optional simply because it is being moved empty.
Do not assume that being legal in Indiana automatically answers every question for a trip through Illinois, Kentucky, Ohio, or another state. Registration reciprocity, equipment requirements, commercial rules, and statutory definitions can be complicated. Before interstate travel, verify the current law for the jurisdictions on your route and determine whether any federal commercial-vehicle rules apply to the operation.
Small Trailers: When You’re Genuinely Exempt
Many light-duty trailers can legally operate without service brakes in Indiana, but there is no single low rating that guarantees an exemption in every state. A small 5×8, 5×10, 6×10, or similar single-axle utility trailer may be rated at 2,990 lbs and remain below Indiana’s 3,000-lb gross-weight threshold when legally loaded. That same trailer may be treated differently in a state with a lower brake threshold or an additional trailer-to-tow-vehicle weight requirement.
It is also important to separate GVWR from actual gross trailer weight. GVWR is the maximum total weight assigned to the trailer by its manufacturer. Actual gross weight is what the trailer and everything on or in it weigh at that moment. If a trailer weighs 800 lbs empty and carries 1,900 lbs of cargo, its actual gross weight is approximately 2,700 lbs. If its data plate lists a 2,990-lb GVWR, the trailer cannot legally or safely be loaded beyond that rating even if an axle underneath it has a higher individual capacity.
A 2,990-lb trailer is not a 3,500-lb trailer merely because it uses a 3,500-lb axle. The frame, coupler, tires, suspension, safety components, and manufacturer certification all contribute to the trailer’s assigned GVWR. Loading a 2,990-lb trailer to 3,200 lbs would both exceed its rating and place it at or above Indiana’s statutory brake threshold.
When shopping, check the manufacturer’s certification label, VIN information, title or registration paperwork, published payload capacity, tire ratings, and the trailer’s actual empty weight. Payload is generally calculated by subtracting the trailer’s empty weight from its GVWR, but installed options can change the finished trailer’s weight. When the load is close to the limit, use a certified scale rather than estimating the weight of equipment, attachments, fuel, tools, pallets, or materials.
Products Where This Question Actually Comes Up

A small single-axle H&H configuration rated at 2,990 lbs can remain below Indiana’s brake threshold when it is not overloaded. A brake controller in the truck does nothing, however, unless the trailer itself is equipped with compatible brakes and the necessary wiring. Customers who expect to tow near the upper end of a light trailer’s capacity should compare it with a factory brake-equipped configuration instead of assuming that adding brakes later will be a simple plug-in upgrade.
Step up to a Diamond C LPX equipment trailer and the conversation changes completely. The current LPX starts at 15,500 lbs GVWR and uses tandem 7,000-lb Lippert axles as its standard axle package, with higher-capacity Lippert configurations available. Likewise, a current Darkhorse DHW 7×16 enclosed cargo trailer in a 7,000-lb configuration uses two 3,500-lb axles with electric brakes. These trailers must be connected to a compatible, functioning brake-control system when required, and the breakaway equipment must be operational.
The Legend UG aluminum utility trailer provides a good example of why the exact build matters. Current 7×12 and 7×14 single-axle configurations sold by Spencer Trailers are rated at 2,990 lbs GVWR and use a 3,500-lb torsion axle. The listed empty weights are approximately 700 to 730 lbs depending on length and equipment, leaving roughly 2,260 to 2,290 lbs of calculated payload. The 3,500-lb axle does not change the trailer’s certified 2,990-lb GVWR.
For enclosed cargo work, a current Darkhorse DHW 6×10 single-axle enclosed trailer is available with a 2,990-lb GVWR and a 3,500-lb axle. That configuration uses a four-way electrical connector and is not listed with factory electric brakes. When operated within its certified rating, it can remain below Indiana’s 3,000-lb gross-weight brake threshold. It should not be treated as universally exempt, however, because another state may use a lower threshold, and the tow vehicle’s owner’s manual may call for trailer brakes at a lower loaded weight.
The Safety Argument Doesn’t Care About the Legal Threshold
Here is the position we hold at Spencer Trailers: the legal threshold is a minimum requirement, not a recommended operating target. Two trailers can have the same 2,990-lb GVWR and behave very differently depending on their actual load, tongue weight, axle placement, tire condition, cargo height, tow vehicle, hitch setup, road grade, and speed.
A light trailer carrying bulky brush may weigh much less than its rating but create significant aerodynamic drag. Another trailer carrying a compact tractor may be close to its GVWR and concentrate substantial weight over a small area. A load placed too far behind the axle can reduce tongue weight and increase sway, while excessive tongue weight can overload the truck’s receiver, rear axle, tires, or available payload. Trailer brakes cannot correct an overloaded or badly balanced combination.
The difference in stopping performance becomes especially important when the tow vehicle is a midsize SUV, crossover, light-duty pickup, or older truck with limited brake capacity. Those extra feet matter when traffic stops suddenly, a deer enters State Road 46, or the combination begins descending a wet grade. A trailer that is technically below a statutory threshold can still be demanding enough that a brake-equipped model is the safer choice.
Do not assume that adding electric brakes to an unbraked trailer will cost only a small fixed amount. A proper conversion may require brake-compatible axle flanges or a replacement axle, hub-and-drum assemblies, brake assemblies, wiring, a junction box, a seven-way connector, a breakaway switch, an onboard battery and charger, and a compatible controller in the tow vehicle. Labor and parts vary substantially by trailer design. In many cases, purchasing the correct factory brake-equipped configuration is more practical than converting a light trailer after the sale.
When the trailer already has electric brakes, the controller must still be set up correctly. Test the brakes at low speed before entering traffic, adjust the gain for the current load, confirm that the manual control applies the trailer brakes, and investigate any warning, weak braking, grabbing, or wheel lockup. Brake adjustment, bearing condition, wiring connections, magnets, drums, tires, and battery condition all affect the system’s performance.
If you regularly tow a trailer close to 3,000 lbs, travel in hills, use a relatively light tow vehicle, or encounter frequent highway traffic, a brake-equipped trailer is worth serious consideration even when a particular in-state trip could be legal without it. The right decision should be based on the complete truck, trailer, load, and route rather than the smallest number allowed by statute.
Breakaway Systems: A Related Requirement
A breakaway brake system is related to the service brakes but serves a different purpose. It automatically applies the trailer’s brakes if the trailer separates from the tow vehicle. Indiana specifically requires automatic brake application during an accidental breakaway on trailers and semitrailers at or above the statutory 3,000-lb gross-weight threshold. Federal rules impose comparable breakaway requirements on covered commercial trailers that are required to have brakes.
On a typical electric-brake trailer, the breakaway system includes a dedicated battery, a charging circuit, a switch, a removable pin, and a lanyard attached to the tow vehicle. Pulling the pin closes the circuit and sends battery power to the trailer brakes. The breakaway lanyard should be attached to a secure point on the tow vehicle that is independent of the hitch ball and safety chains, so separation of the coupler can still activate the system.
Hydraulic surge-brake trailers may use a different mechanical or hydraulic breakaway arrangement, so not every legal breakaway system looks identical or requires an electric brake controller. The correct system depends on the brake design installed by the manufacturer.
Before towing, confirm that the battery is charged, the switch and pin are not damaged, the lanyard can pull freely, and the trailer brakes activate when the system is tested according to the manufacturer’s instructions. Do not leave the breakaway pin pulled as a parking-brake substitute. Continuous application can discharge the battery and may overheat electric brake components.
State Law Verification: Do It Before You Hitch
Verify the current brake law before towing, especially when the trailer is close to a statutory threshold. Generic online charts can be useful for identifying questions, but many are outdated or omit important exceptions. Read the current state code and determine whether it uses actual gross weight, GVWR, registered weight, unladen weight, axle count, tow-vehicle weight, stopping distance, or a combination of those factors.
For Indiana questions, useful starting points include the current Indiana Code, the Indiana Bureau of Motor Vehicles, and the Indiana State Police. A trailer dealer can help identify the trailer’s specifications and equipment, but the issuing or enforcing agency is the appropriate source for a definitive interpretation of the law.
If the combination is being used for business, do not assume that the absence of a CDL requirement means federal motor-carrier rules do not apply. For interstate commerce, the Federal Motor Carrier Safety Regulations can apply to a vehicle or combination with a GVWR, GCWR, gross vehicle weight, or gross combination weight of 10,001 lbs or more. Federal brake rules generally require brakes on all wheels of covered commercial motor vehicles, subject to limited exceptions for certain trailers weighing 3,000 lbs or less and meeting the applicable 40-percent weight test.
CDL classification is a separate issue. A Class A CDL is generally implicated when a commercial combination has a GCWR or gross combination weight of at least 26,001 lbs and includes a towed unit with a GVWR or gross weight of more than 10,000 lbs. A combination can therefore be subject to some federal motor-carrier safety requirements well before it reaches the Class A CDL threshold.
Farm registration, covered-farm-vehicle provisions, occasional personal transportation, and other exemptions can affect particular regulatory obligations, but they should never be treated as blanket permission to operate an unsafe trailer or ignore applicable brake-equipment laws. Verify the exact exemption, geographic limits, vehicle markings, load, and type of operation before relying on it.
Questions to Ask Before You Buy
- What are the trailer’s GVWR, actual empty weight, calculated payload, axle ratings, and tire ratings?
- Does the applicable law use GVWR, actual gross weight, registered weight, or another measurement to determine whether brakes are required?
- Will I tow through another state or use the combination commercially in a way that triggers additional requirements?
- Does my tow vehicle have a compatible brake controller, seven-way connection, adequate tow rating, available payload, and correctly rated hitch?
- If the trailer requires brakes, are the service brakes, breakaway switch, battery, charging circuit, wiring, and brakes on each required wheel fully operational?
