You’re loaded up, the coupler or gooseneck connection is secured, the safety chains are attached, and you’re ready to pull out of the lot. But do you know Indiana’s actual speed rules when you’re towing? Indiana does not automatically assign every trailer a lower speed limit than the number shown on the sign. The lawful limit depends on the highway, the posted limit, the vehicle’s registered or declared weight classification where applicable, and whether road, traffic, or weather conditions require a slower speed. And if your trailer has a gross weight of 3,000 pounds or more without legally adequate brakes and an automatic breakaway function, the combination does not meet Indiana’s trailer-brake requirements.
This isn’t meant to scare you off the road. It’s the information you should know before you tow, whether you’re hauling a Diamond C equipment trailer loaded with a skid steer or pulling a 6×12 enclosed cargo trailer to a craft fair. The posted speed limit is only the maximum under favorable conditions. Your truck’s ratings, the trailer’s ratings, tire speed and load ratings, cargo placement, braking system, road conditions, and traffic can all require a slower operating speed.
The Speed Limit Question: It Depends on Your Declared Gross Weight
Indiana does not impose a universal lower speed limit solely because a passenger vehicle or light truck is towing a trailer. In general, the posted maximum applies unless a lower statutory limit applies to the vehicle or conditions make that speed unsafe. Local authorities and INDOT can also establish lower posted limits on particular roads or highway segments.
Under IC 9-21-5-2, the normal maximum on an interstate outside a qualifying urbanized area is 70 mph. A vehicle other than a bus with a declared gross weight greater than 26,000 pounds is limited to 65 mph on those interstate segments. Interstate 465 has a statutory maximum of 65 mph. Indiana law also provides a 60 mph maximum on certain divided, four-or-more-lane non-interstate highways outside qualifying urbanized areas, while the general statutory maximum is 55 mph where another listed limit does not apply. The maximum in an urban district is generally 30 mph unless a different limit is posted under lawful authority.
That means the rule cannot accurately be reduced to “70 mph for every towing combination under 26,000 pounds and 65 mph for every combination above it.” The statute uses declared gross weight, which is a registration term, rather than simply asking what the truck and trailer happen to weigh together on a particular trip. Posted signs and the type and location of the highway still control. If your truck, tractor, or combination is registered in a heavier class, verify the declared weight shown by the registration and the rules that apply to that vehicle instead of estimating the speed limit from the trailer’s GVWR alone.
Even when 70 mph is legally available, it is a maximum, not a recommended towing speed. Pulling a heavily loaded equipment trailer at 70 mph produces substantially more kinetic energy and requires more room to slow than the same combination at 60 or 65 mph. Higher speed also reduces the time available to respond to sway, a tire failure, a sudden lane change, or stopped traffic. Choose a speed that remains within the lowest applicable limit or rating, including the posted limit, the towing vehicle manufacturer’s instructions, the trailer and tire ratings, and any hitch or weight-distribution-system limitations.
What “Declared Gross Weight” Actually Means
Declared gross weight is not automatically the actual combined scale weight of your pickup, trailer, passengers, and cargo. Under Indiana’s registration definitions, the declared gross weight of a trailer is its empty weight plus the heaviest load it will carry during the registration year. For a truck, it is the truck’s empty weight plus the heaviest load the truck will carry during the registration year, and the statutory definition states that it does not include a vehicle towed by the truck. For a tractor used with a semitrailer, the declaration is a gross combination figure that includes the tractor, the applicable semitrailer or semitrailers, and their heaviest anticipated loads.
That is different from actual gross weight, GVWR, and GCWR. Actual gross weight is what the vehicle or combination weighs at the time. GVWR is the maximum loaded weight assigned to an individual vehicle by its manufacturer. GCWR is the maximum combined rating established for the tow vehicle and trailer combination. Those figures remain critical for loading, licensing, braking, axle compliance, and safe operation, but they are not interchangeable with Indiana’s declared-gross-weight registration term.
For example, a three-quarter-ton pickup pulling a 14,000-pound-GVWR dump trailer should not determine the applicable speed rule by adding the two advertised GVWR figures and treating the result as the truck’s declared gross weight. Check the registration, the vehicle classifications, the posted highway limit, and the actual operating weights. Never exceed the truck’s GVWR, the trailer’s GVWR, either vehicle’s GAWR, the tow vehicle’s GCWR, the receiver or hitch rating, the coupler rating, or the tire and wheel ratings.
Lane Rules on Indiana Interstates
Indiana has explicit interstate-lane restrictions that cover trucks, truck tractors, road tractors, trailers, semitrailers, and pole trailers. Because the statutory language expressly includes a trailer, these restrictions are relevant to ordinary pickup-and-trailer combinations as well as larger commercial combinations. They are not limited to trailers above a particular weight.
Under IC 9-21-8-12, a person operating a trailer on an interstate generally must use the far right lane. The statute permits another lane when passing a slower vehicle, entering or leaving the highway, or responding to a special hazard that makes an alternate lane necessary for safety.
On an interstate with three or more lanes in one direction, IC 9-21-8-13 permits the covered vehicles to operate in either of the two far right lanes. The statute does not permit operation in lanes farther left except when entering or leaving the highway or when a special hazard requires another lane for safety. Accordingly, on a three-lane interstate, a towing combination may use the right lane or the center lane but generally may not use the far-left lane.
The practical effect is straightforward. If you’re towing a 20-foot car hauler on I-69 toward Indianapolis, remain in the right lane on a two-lane segment except for a permitted pass or another listed exception. Where the interstate expands to three or more lanes in your direction, stay within the two far-right lanes. Signal early, leave enough space, complete any permitted pass without exceeding the speed limit, and return to the appropriate lane when it is safe and lawful.
Brake Requirements: The 3,000-Pound Line
Indiana Code draws a clear line at 3,000 pounds of gross trailer weight. Subject to the related provisions of the brake chapter, IC 9-19-3-3 requires a trailer or semitrailer with a gross weight of at least 3,000 pounds, when operated on a highway, to have brakes adequate to control its movement and to stop and hold it.
Those brakes must meet two specific requirements:
- They must be designed so the driver of the towing motor vehicle can apply them from the cab.
- They must be designed and connected so they apply automatically if the towed vehicle accidentally breaks away.
That second requirement is the breakaway function, and it is essential. A trailer covered by the statute must be able to apply its brakes automatically if it separates from the tow vehicle. On a typical electrically braked trailer, that means maintaining a charged breakaway battery, an operable switch, correctly connected brake wiring, and a breakaway cable attached to a suitable point on the tow vehicle rather than looped only around a removable ball mount. The cable should be routed with enough freedom for turns but without so much slack that it drags or catches on trailer hardware.
Check the breakaway system according to the trailer and component manufacturers’ procedures. Do not leave the breakaway pin pulled for an extended period merely as a parking brake; doing so can discharge the battery and overheat or damage brake components. The trailer’s regular braking system and breakaway system serve different purposes, and both need to work before the trailer enters the highway.
A trailer below 3,000 pounds actual gross weight is not covered by the specific 3,000-pound trailer-brake mandate in IC 9-19-3-3. That does not make every unbraked load below the threshold safe for every tow vehicle. The combination must still be controllable, the tow vehicle must stay within its ratings, and the driver must operate at a reasonable and prudent speed for the load and conditions. Also remember that a trailer with a GVWR near 3,000 pounds can reach the statutory gross-weight threshold after cargo is added. Use the trailer’s empty weight and the actual cargo weight instead of guessing.
Brake Controller Is Your Responsibility
If a trailer uses conventional electric drum brakes, the tow vehicle needs a compatible electric brake controller so the driver can apply and modulate those brakes from the cab. Many late-model pickups have an integrated proportional controller, while others can accept an aftermarket proportional controller through a vehicle-specific harness. A proportional controller generally adjusts trailer braking in relation to the tow vehicle’s deceleration, but it still must be installed, adjusted, and tested for the particular trailer and load.
Not every legal trailer-brake system is identical. Some trailers use hydraulic surge brakes, and heavier configurations may use electric-over-hydraulic or other systems requiring compatible controls. Do not install an electric controller and assume it will operate every hydraulic actuator. Confirm compatibility among the truck, controller, trailer connector, actuator, brake type, and breakaway system. Safety Chains and Hitch Coupling
Under IC 9-20-9-8, each trailer and semitrailer hauled by a motor-propelled vehicle must be attached by suitable coupling devices and safety chains or devices. The statute calls for a safety chain or device on each side of the coupling at the extreme outer edge of the vehicle. Each chain or device and its connections must be strong enough to haul the loaded trailer. The law also recognizes qualifying vehicles and safety equipment that comply with applicable federal motor-carrier or federal motor-vehicle safety requirements.
For a conventional bumper-pull trailer, cross the chains beneath the coupler when the trailer and hitch manufacturers direct that arrangement, connect them only to rated receiver attachment points, and leave enough slack for a full turn without allowing the chains to drag. Do not attach both hooks to the ball, removable ball mount, or another component that could depart with the primary coupling. Gooseneck and other coupling systems must use the safety equipment appropriate to their design and ratings.
The drawbar or other connection between two vehicles generally may not exceed 15 feet from one vehicle to the other. The statute also requires coupling and safety devices that prevent the trailer or semitrailer from being deflected more than 6 inches from the path of the towing vehicle. That provision describes the required restraint of the coupled combination; it is not permission for six inches of looseness at the hitch.
Always match the ball diameter to the coupler size marked on the trailer. A 2-inch ball must never be used with a 2-5/16-inch coupler. Close and positively latch the coupler, install the specified pin or lock, verify the gooseneck or fifth-wheel jaws when applicable, and perform a visual and pull test before traveling. Lubricate components only where and as the hitch or coupler manufacturer recommends; grease must never substitute for correct sizing, adjustment, or inspection.
Weight Limits for Combined Vehicles
Indiana’s vehicle-weight rules are not a single combined-weight number. IC 9-20-4 governs axle, tandem-axle, axle-spacing, and related weight limits, while other provisions establish route-specific gross limits and exceptions. On the interstate system, IC 9-20-5-2 generally limits total gross weight, with load, to 80,000 pounds and also applies federal bridge-formula and axle restrictions. Lower practical limits usually come from the truck, trailer, hitch, tires, registration, roadway, or axle ratings long before a pickup-and-trailer combination approaches that commercial ceiling.
These rules matter to commercial operators, but private towing is not exempt from equipment ratings or highway size-and-weight laws merely because no payment is involved. A trailer’s payload is not its GVWR. Payload is approximately the trailer’s GVWR minus the trailer’s empty or curb weight, subject to the manufacturer’s stated ratings and the weight carried on each axle and at the hitch. Tongue or pin weight also becomes load carried by the tow vehicle and must be included when checking the truck’s payload, GVWR, rear-axle rating, tires, receiver, and hitch.
Length matters too. Under IC 9-20-9-1, a combination of two vehicles coupled together, including the load, generally may not exceed 60 feet total, although the statute contains specific exceptions for certain vehicle-transport, drive-away or tow-away, utility, oil-field, and qualifying construction combinations. Separate rules apply to some truck-tractor and semitrailer combinations. A pickup and long gooseneck or equipment trailer should be measured from the foremost point of the tow vehicle to the rearmost point of the trailer or load, and an operator should not assume that a factory-built trailer makes every possible tow-vehicle pairing compliant.

What This Means When You’re Shopping for a Trailer
Every trailer we carry at Spencer Trailers has a manufacturer certification label showing its GVWR and GAWR information. When you’re comparing a tandem-axle enclosed trailer rated at 7,000 pounds with a lighter single-axle cargo trailer rated below 3,000 pounds, you’re not just comparing cargo space. You’re comparing empty weight, available payload, axle ratings, brake equipment, breakaway equipment, coupler requirements, tire capacities, and what the tow vehicle needs to control the trailer legally and safely.
Do not assume a trailer stays below Indiana’s brake threshold merely because its empty weight is below 3,000 pounds. IC 9-19-3-3 uses the trailer’s gross weight when it is being operated. A trailer that weighs 2,200 pounds empty reaches 3,000 pounds after only 800 pounds of cargo. Conversely, never load a trailer to 3,000 pounds if its GVWR, axle ratings, tire ratings, or other manufacturer limits are lower.
Most customers towing for construction, landscaping, agriculture, vehicle transport, or other equipment work operate trailers rated well above 3,000 pounds. Current Diamond C equipment, dump, and flatbed lines cover a wide range of capacities and configurations. Examples include GTU utility trailers, GST single-axle telescopic dump trailers, LPT heavy-duty telescopic dump trailers, LPX equipment trailers, HDT hydraulically dampened tilt trailers, DOD deck-over dump trailers, and FMAX gooseneck flatbeds. The exact GVWR, empty weight, payload, axle configuration, brakes, dimensions, and required tow equipment vary by model and selected options, so the certification label and current build specifications for the individual unit control.
A loaded enclosed trailer carrying tools and materials can cross 3,000 pounds sooner than many buyers expect. A dump trailer carrying gravel, soil, demolition debris, or firewood can reach its payload or axle limits with a bed that does not look full. Material density varies greatly, so estimate or weigh the load and confirm the trailer’s actual empty weight rather than relying on bed volume alone. Plan for properly maintained brakes and breakaway equipment whenever the statutory threshold applies. It’s the law, and more importantly, it gives the tow vehicle a realistic chance to control the load.
Trailer brakes do not increase the truck’s tow rating or make an overloaded combination legal. Before selecting a trailer, compare the truck’s tow rating, GCWR, GVWR, front and rear GAWR, payload allowance, receiver or gooseneck rating, and tire capacities with the trailer’s GVWR, empty weight, expected payload, and anticipated tongue or pin weight. Depending on the configuration, a properly adjusted weight-distribution hitch may be required or recommended for a bumper-pull trailer, but it must be compatible with the tow vehicle, receiver, coupler, and trailer frame.

Indiana’s towing laws are manageable, but they require you to know which number answers which question. What are the truck’s and trailer’s actual loaded weights? What are their GVWR, GAWR, GCWR, hitch, coupler, tire, and wheel ratings? What declared weight appears on the applicable registration? Are the brakes, breakaway system, lights, coupler, and safety chains correctly installed and working? What speed and lane rules apply to the road you’re using? Answer those questions before you leave, and remember that a posted speed is a legal maximum under suitable conditions, not a target a loaded trailer must maintain.
